Consumer commission fines Bank of Baroda for not providing subsidy under Awas Yojana

Adistrict consumer commission has directed Bank of Baroda to pay Rs 1.15 lakh to Mohali residents for unable to provide them benefit under Pradhan Mantri Awas Yojana.

In their complaint, Abha Dobriyal and Om Parkash, a couple based in Mohali, mentioned that they obtained a housing loan of Rs 50 lakh from Bank of Baroda on October 8 in 2018, and to avail benefits of subsidy under the Pradhan Mantri Awas Yojana, submitted necessary documents to the bank. Despite the long wait, the complainants did not get a response of any benefit.

Hence, they lodged a complaint alleging deficiency in service and unfair trade practice on the part of the bank causing them financial loss, harassment and mental agony.

The Bank of Baroda, in its reply, said that the complainants never approached it with regard to said scheme, claiming they neither were provided with any application nor any documents. The bank’s response added that the complainants might have applied for the scheme online, and but they have no clue about any such application.

However, the Housing and Urban Development Corporation Limited (HUDCO), in its response, said that that the bank uploaded subsidy claim of the complainants on July 23 in 2020, but it was rejected by the corporation’s portal due to wrong installment number and mismatch of the cumulative loan disbursement with the loan disbursement submitted up to previous installment. HUDCO blamed Bank of Baroda for not uploading the revised claim form.

The District Consumer Disputes Redressal Commission of Chandigarh said that Bank of Baroda failed to remove the objection or query raised by the HUDCO in respect of application of complainants, and also failed to upload the revised claim form.

The district commission thus directed Bank of Baroda to pay a compensation of Rs one lakh to the complainants for rendering deficient services along with litigation cost of Rs 15,000.
