Pakistan: Islamabad court dismisses defamation case against ex-PM Imran Khan – Details inside

On Saturday, a district and sessions court in Islamabad dismissed a Pakistani Rupees (PKR) 20 billion defamation case filed against ex-Prime Minister Imran Khan by former Chief Justice of Pakistan Iftikhar Muhammad Chaudhry, reported The Express Tribune.

Iftikhar Chaudhry, in July 2014, sent a defamation notice worth PKR 20 billion to Imran Khan. He accused him of rigging in the general poll held in 2013. After the notice, the legal team of Chaudhry warned of starting legal proceedings if Imran Khan did not give an apology for his statements.

In January 2015, Chaudhry formally registered a case. In the lawsuit, the former Chief Justice of Pakistan blamed Imran Khan for using derogatory remarks against him in a statement (published on June 27, 2014), and levelled groundless allegations against the judiciary.

Decision in favour of Imran Khan

After the lengthy proceedings, the court announced the decision in favour of Imran Khan and dismissed the lawsuit filed by Chaudhry. The court called the defamation notice time-barred, according to The Express Tribune report.

The judgement underlined the significance of including the date of knowledge of publication of defamatory material in the complaint. The court made it clear that under the Defamation Ordinance 2022, the complainant needs to file the lawsuit within six months from the date of knowledge of the publication of defamatory material.

As per Section 12 of the Defamation Ordinance 2002, failure to do so would render the suit time-barred, according to The Express Tribune.
